If you are an immigrant living in Virginia, it is important to understand that you have constitutional rights — regardless of immigration status.
If Immigration and Customs Enforcement (ICE) officers come to your home, remain calm and remember the following:
You do not have to open your door unless ICE presents a valid judicial warrant signed by a judge that includes your correct name and address.
An ICE administrative warrant (Form I-200 or I-205) does not authorize officers to enter your home without your consent.
You have the right to decline to answer questions about your immigration status, place of birth, or how you entered the United States.
You may state:
“I am exercising my right to remain silent.”
Unless officers have a valid judicial warrant, you do not have to allow them to search your home, vehicle, or personal belongings.
You may clearly say:
“I do not consent to a search.”
You should not sign any immigration documents without first speaking to a qualified immigration attorney. Signing certain forms may affect your legal rights or result in removal proceedings.
